When rights are decreased - as per the Bill of Rights - then it is Un-Constitutional. That's why Prop 8 in California was struck down.
Prop 8 was passed by the voters - How? i.e. probably Demagoguery (see Rush Limbaugh example)
1:20 - Colbert Thinks his marriage is invalidated because ANYONE can get married. (Must be a rumor as that's how the GOP functions)
Note: Technically, each religion has a different ritual for marriage while with the State you just register you "marriage"/"union"/"partnership" the way you would register a car. Thus anyone married the Christian, Hindu or Muslim way can all be registered by the State as married couples even-though each couples religion wouldn't recognize the other married couples as their religious ritual is invalid in the first couple's religion (can you imagine Christians getting married the Hindu way of going in circles around a fire?). The State's function in marriage is to provide State rights as one would to a business. You start a business you have to register it. You want to be "married" you have to register it so it's officially recognized by the State. That marriage can be ignored by any religious group (and often is as is there right to heaven). Problem is that over-time people have forgotten that Religion and State are NOT the same so they freak out and think a Law can make you gay.
Note that rights for US Citizens are being INCREASED and NOT decreased.

5:00 - 'No taking away votes from anyone, you just don't do that' Emily Bazelon - Colbert Replies: We'll see what happens in the future. i.e. given recent American history, Colbert knows that the GOP is getting ready to do electoral fraud for the mid-term and general elections. It's understandable. Not everyone in the States watches Fox News (though they are doing their very best to change that through one trick or another).
